The federal district court for the Southern District of California issued a ruling regarding the TCPA on April 9th granting Plaintiff’s motion for preliminary approval of a class action settlement against Wells Fargo Bank, N.A.  Plaintiffs represented by Hyde & Swigart as well as the Kazerouni Law Group, APC were able to certify for settlement purposes:


All wireless phone subscribers and users within the United States of America, who received any text message/s from Defendant in connection with, or as a result of, its send/receive money product program, who were not customers of Defendant at the time the text/s were sent, which text messages were sent during the Class Period.


Plaintiff alleges that Wells Fargo sent unsolicited text messages to non-Wells Fargo customers in connection with its send/receive money product program, in violation of the Telephone Consumer Protection Act.


The Court appointed Joshua B. Swigart of Hyde & Swigart and Abbas Kazerounian of the Kazerouni Law Group, APC as class counsel, finding they were qualified from their years of experience litigating complex actions arising under privacy and consumer rights.
